GGB,

I don't understand how the USPO can reject these claims consistently in May 2017, March 2018, Jan 2019 March 2020 and August 2021... but now get those rejections (five years straight!!!) withdrawn.

Because they didn't reject those claims for five years straight on these grounds. Every volley back and forth between the company and the examiner will trigger a new literature/patent search, especially if new arguments are made or claims amended. The issue with Yamanaka et.al. was not brought up until 3/19/2020 with an updated literature search, so this rejection was only from the last interaction and the the first response from NWBO nailed it, apparently. If you do a search on Yamanaka in the file wrapper, you'll see that name first appears on page 185 and not before that (from the 3/19/20 response from the USPTO.

Also..

Talking about a patent attorney playing 3d chess while the USPO was playing checkers. Apparently, NWBO's patent attorney is good (understatement!). WTF!!!

I don't doubt that the patent attorney is very good, but the patent writers are world experts in this field, so I have no doubt that they crafted the response and the patent lawyer put his/her spin on it. In fact, this is a good example for when people complain about how long it takes to do things. They are writing papers, but also dealing with responses to these patent examiners all the time with the multiple patents the have in process (in US and around the world).
