You are misapplying terms. This is moot until you provide me with someone that currently is in production of technology that infringes on MS technology. You are obfuscating the meaning of exclusive commercial rights, with commerce. Yes anyone can do it without rights granted by any patent holder, but this is commerce. The argument then morphs into whether or not anyone is currently using KBLB's patented technology. Trying does not count. So who is in production of such silkworms? Short of providing such a fact leaves you standing in a river, because no one made that bridge yet. It is as moot as someone making things out of regular silk, and selling it as Monster Silk. (on a pirating basis)
No one has made DS either, they can make it in theory, but they are still trying to get to that bridge or find a place to build it. These are points hardly worthy of time and space at this point.
