My statement was accurate: KBLB does not have ‘Exclusive Commercial Rights to sell their products Worldwide.’
In their latest PR, KBLB said: “Under the terms of that agreement, the Company paid for the development of the technology and the costs of patents issued to UND in exchange for exclusive global licensing rights.”
Posters were asserting that KBLB had exclusive global rights under this agreement. UND can only enforce exclusive rights on behalf of KBLB if they have a patent in every country where KBLB wants to sell their silks. Rights for exclusivity are generated by patents. No US patent, no exclusive right here.
Patents serve as a barrier to entry for competitors. A patent can dissuade competitors from moving into a new field.
At the moment, patents are not terribly important, but they probably will be. That is why the company is working with a law firm that specializes in patent filings. These firms charge a pretty penny for their services.
