Good question. Embarq was supposed to be based on Powerstream, which ANI could never commercialize and an obvious failure. So, NVEI took 80% of a failed concept and hired Hellosoft to make something out of nothing. Hellosoft has been conspicuously absent for several months, so it is safe to assume they have departed. Now they hired eSilicon to make whatever they have into something the Taiwanese foundry can mass produce.

Given this history of "Chinese menu" chip development, there is absolutely no way they have any patentable intellectual property. Unless you can patent a Photoshop reproduction of a fake chip.
