There is no explanation for it, other than a Judge who lacks the intelligence to apply the law properly, or a Judge who desired a predetermined outcome to her liking, and then did whatever she thought she must, to squeeze the square peg of the facts into her round hole of an outcome.
I do not see a plausible rationale, and I think Singer has been, and will be all over it.
