"They may not want to rush to court. Filing an appeal to be heard in 12-18 months would bridge the time between now and approval for vascepa in Europe and if an anda is filed they can seek an injunction. The long game seems to be their best option."

Agree 1000%. It can be dragged out even longer than 12-18 months (per SA: average 518 days), what with (if necessary) an en banc appeal, possible SC appeal, FDA bio-equivalence approval, plant inspections/approval....

I think it's idiotic at this point to advocate an "expedited appeal". The only way you'd want that is if you're 100% sure of a win. What if they get an expedited appeal - and the appeal is denied?

Anyone 100% sure at this point?

HDG is correct. Sell while max. time is left on EU and USA and let BP clean up the mess.

But a question we need to answer right now is what is execution in US? Business as usual? Then possibly we perfectly build the mkt for generics when appeal is done and we lose again.

Another question is how much is the bond? If it is really significant, yeah, let us keep paying two bastards like settlement and drag the law suit until 2029.
