All good points, Phaedrus. As long as they file financials and there is still significant value left, UDFI will be able to correct the narrative that Bass has put out there.

If they get things in order, I think they will be able to start lending again. It all depends on what the portfolio look is like- if there is 25% value left, they should think about winding down. If there is 75% or more I think they will recover in time.

After reading through both UDF’s info and Bass, I do not think a jury will be sympathetic to Bass.

His actions were excessive. An example, if true, is that Hayman allegedly sent anonymous packages to municipalities in an attempt to interfere with the entitlements and/or approvals for developments.

That seems to me to be interference well beyond just letting people know there are concerns with UDF’s loan portfolio.

I could name other examples but that is the clearest example in my mind that Bass overstepped and seems vulnerable to UDF in the lawsuit.

The damages to UDF are in the hundreds of millions of dollars. Bass could have a lot of exposure here.
