Yes, they could choose to appeal but it is unlikely. If you read the transcript of the hearing, their case was weak. I thought it was actually embarrassing for the RPX lawyer at times.
It is my understanding that they are not allowed to bring up any new reasons for their claims only review the weak case they have.
Also, keep in mind this is only for patent # 822. All decisions in our favor on the other TWO patents are now FINAL. No appeals!
