The relationships may not be as arbitrary as you portray. A few quick google searches reveal strong ties between Freeh, Pepper Hamilton and Celldex. When both Ondra and Freeh group have conflicts coming at you from both sides, it is appropriate to close ranks. Since Freeh would have been working for Woodford, not NWBO, he would not necessarily need to disclose those conflicts.

Some things are better protected as trade secrets. It can be relatively straight forward to examine a product (e.g. a computer system) being sold and determine if a competitor is infringing on a patent. It is much harder to know that they are using proprietary patent-protected manufacturing processes without access to their manufacturing facility. It is all the more difficult when the manufacturing is occurring in another country. If the competitor does not understand all the details on how DCVAX is produced it then become impossibles (or at least far more difficult) for them to duplicate it patent or no patent.
