Except, when they mention only 8 responded, they omitted the fact that the thousands others were never notified, and if notified may have responded like the 8 who did.
Then those "thousands of others" should ask their discount brokers (DTCC members) why they didn't notify them.
The court doesn't care if a TDA notified its clients or not, that it had received a court ordered notification from COR. Whether or not to notify their clients was/is a business decision of the discount brokers.
The response of COR was primarily directed at the TDA response. They did so by citing points of law. The Judge won't make his ruling on the receivership based on mass retail Emailings.
