I wasn't planning to post here again, but here's a question you may know the answer to.

I know all about the CDA protections for boards. But, if Matt were to receive credible evidence that a poster is using IH for illegal purposes, and continues to allow that poster to post, would he be liable to those who lost money as a result of the illegal postings? And how about possible liability if he were to knowingly stifle information about the illegal activities?

Now, I don't know for a fact that anybody is using IH for illegal purposes, so this is a hypothetical question. But assume it were true, and Matt knew or had credible evidence that it was true, and allowed the poster to continue posting. Does actual knowledge that a board is being used for illegal activities and failure to take reasonable steps to protect the victims of that activity overcome the CDA protections?

Do you happen to know?

Let's look at something in the real world (can you folks tell, I like putting things into perspective by now?!)..

Listen up, CoolBreeze.

Let's say there is this really creepy guy that always hangs out in a public park. You pick him out and watch him. He then proceeds to hurt some woman. You find out about it. So you watch him. Then, he comes up to another woman. You scream as loud as you can to warn the woman. But she just looks at you and thinks "Man, you're wierd!" ... So the guy proceeds to hurt another woman. You have watched it all in action and have the evidence. Two times now. So you are hanging out in the park again, and what do you know, the guy is there again. He proceeds to hurt another woman. You scream again. She doens't listen, because some whacko in the park is screaming at her. So she gets hurt. And it goes on and on because what does this guy have to fear? Some dude sitting in a park screaming? That's it?

I ask you. How would the story have changed, if you would have gotten the police involved and provided them with the evidence that you HAD and COULD PROVE him GUILTY with? A lot less women would have been hurt had you done the honorable thing. Actions speak louder than words.
