I wasn't planning to post here again, but here's a question you may know the answer to.

I know all about the CDA protections for boards. But, if Matt were to receive credible evidence that a poster is using IH for illegal purposes, and continues to allow that poster to post, would he be liable to those who lost money as a result of the illegal postings? And how about possible liability if he were to knowingly stifle information about the illegal activities?

Now, I don't know for a fact that anybody is using IH for illegal purposes, so this is a hypothetical question. But assume it were true, and Matt knew or had credible evidence that it was true, and allowed the poster to continue posting. Does actual knowledge that a board is being used for illegal activities and failure to take reasonable steps to protect the victims of that activity overcome the CDA protections?
