Revlis--The discovery dispute would not go to the Supreme Court. Otherwise, I think I generally agree with your comments that the complex case designation would permit the Court to set the discovery schedule so that discovery would first be limited to whether Nokia was damaged within the meaning of the Lanham Act and permit IDCC to file for summnary judgment. I think IDCC hopes that the judge would schedule a hearing on this, to show the court how weak Nokia's claims are. I can't believe that any federal judge would be impressed with Nokia after hearing the nature of their claim that remains in this suit. Remember, the parties have not yet been before the judge as the Motion to Dismiss was decided without oral argument.
