Whizzer,

I can see the discovery dispute going all the way to the supreme court. IDCC wants to limit the discovery to the damage part of the case since that will be the issue decided in the summary judgment. If there is no damage, there is no case. Nokia is saying that would make the discovery one sided where Nokia would have to provide all of the discovery and IDCC none. If the case is ruled as a complex case, then that would be the result otherwise the discovery could proceed on both issues of whether the 3G patents are essential as well as the damage part. whizzer, how do you see it?
