It’s a matter of degree. In no way am I saying that Amphastar/WPI can skirt significant damages based on what has already transpired; however, the less the cumulative sales by WPI have been when the case is ultimately decided, the less WPI’s damages are apt to be. (I’m presuming that Amphastar’s purported indemnification of WPI does not entirely absolve WPI from having to pay.)
