Jim:Not sure I agree that anyone is waiting for a CAFC decision to make the deal--yes it could come today or tomorrow or next week or God knows when. And no doubt it is important ALTHOUGH IMHO one of the reasons the follow on action was filed was to make clear that NOK will pay one way or the other, as well as a shot across the bow of other infringers past present and future.

As I have considered why a company in the middle of being sold would file a lawsuit my take on it is that it simply confirms that our 3G IP IS valuable notwithstanding the CAFC result--which the consensus here is that we will get a favorable decision anyway.

However, at this point the notion that the CAFC result over a few of our MANY MANY patents for 3G would devalue the company is mistaken IMHO. I acknowledge that the stock would be hit by a negative result and prior to the buyout talks it would have been a big deal in the stock--one reason IDCC should have filed follow on actions a LONG LONG time ago--with other patents rather than waiting for the continuation patents to issue. But water under the bridge.

Seriously anyone considering buying this company realizes that our 3G IP will ultimately hold up whether it is the current patents at issue in the ITC/CAFC or any of a slew of others. And they are more interested in our 4G/LTE IP anyway, not to mention the cutting edge video compression and MTM and network of networks and bandwidth crunch solutions.

So I disagree that the buyout is contingent upon or would really be affected by the CAFC outcome which could come anytime including not until next year.
