at the opening of the hearing, last wednesday, rosen set out the way the case would layout. in addition, he indicated there was agreement between the parties to only ask about certain issues, especially in "tranche 3" with is the IT portion.

before lunch, he and sargent got into a bit, but I didn't hear what it was about...by wanting to question kosturos on non-IT related issues, rosen/strochak believe that the ec is breaking their agreement. sargent/starke want the right to talk to kosturos about other issues that have come up.

as the judge pointed out, they could simply have called him as witness and asked the same questions...

I think this is another example of them circling the wagons and getting jumpy when their plans go awry.
