There are many options for what a settlement looks like. Both parties will get and give. I wouldn't even wage a guess at how that will fall out - and we may never know.

Under your scenario, Scanbuy gets access to at least part of NeoMedia's IP, but NeoMedia gets no IP from Scanbuy. Could be.

There is no such thing as "even steven" and both parties can think they won (beauty is in the eye of counsel). However, if I was NeoMedia and had to hand over some of my toys, I will certainly be asking for some of Scanbuy's toys. This also helps eliminate Scanbuy's lawsuit against NeoMedia which is something the judge will be looking for.

As this board has proved, there are many guesses on how this will work out. I have no idea. I am sure the drafts have been all over the board.
