and you bet anyone can sue anyone .. but the SEC investigation usually end up with them suing the insiders/company for fraud and the class action lawsuit will open them for discovery
( don't forget this class action lawsuit is and was set up by the share holders of Spongy )

the other suit, suing the other sponge company in very bad timing and in my opinion short on cause and merit - no way can they show loss of revenue or damage now with the SEC investigation and the company's own share holders suing them ..
