I think Malko's point about Toshiba is that the arb panel will know with confidence that a top class group of engineers with expertise in the technology, and a very capable group of patent lawyers, have looked at the same InterDigital IPR that Nokia is talking bad about. IMO after looking at what Toshiba, NEC, and others determined to do, the arb panel will reach a "logical" conclusion that Nokia is full of BS and cheating.

If that's on target(?), then both Nokia and InterDigital have a pretty good idea of what is coming from the arb panel. Some might jump to the conclusion that "Nokia will settle". That's cool if they offer what IDCC management believes we are due, but this investor is keeping his expectations set for IDCC going the distance regardless of what the nasty Nokia buggers throw up on the table now that they have been called to account.

Consequences change behavior. Letting Nokia off with paying only what was always fair is not teaching them, or the rest of the cheating slackers, anything. InterDigital settled with SONY/Ericsson in good faith that the industry would respect the results and the terms in their contracts. Not so fast this time IMO. Let's nail one to the wall and THEN see how the others feel about being next.

Now, if THAT is on target(??), what are the other slackers thinking at this point, i.e., if you were calling the shots at Motorola and knew you had some decisions to make regarding what your firm owes InterDigital, would YOU be comfortable sitting and waiting for the Nokia results? My hope is Nokia going the distance while we see some OTHERS settle. Be great to see everybody BUT Nokia licensed before the arb panel reports out IMO. THAT would be a Daisy, LOL! Hang 'em high when they cheat, and the cheating will stop.
