I feel blindsided and pretty shocked. I think that based on this settlement the units are pretty much worthless based on not knowing what the legal fees would be, what jpm future fabricated expenses are likely to be and what the proceeds from an offering by pioneer are likely to be. As a skeptic I can only look at this settlement as a payment to the attys for their time and effort and getting chase and pxd permanently off the hook. As a unitholder I would never agree to it. I would hope that if enough unitholders write the judge and protest the settlement as not be fair to the existing and long suffering unitholders our rights should be protected, meaning at the very least we would be permitted to mount our own lawsuit against chase and pioneer. As a member of the W Group, I have yet to hear from our leader but I hope that we will oppose this settlement as presently outlined as a group.
