One thing that should be absolutely forbidden by the judge is that the plaintiffs must be barred from buying the properties themselves. Otherwise they are screwing the unitholders.

The provision in this agreement that they get to designate a preferred buyer should go. There is no reason for this and it appears riddled with self-dealing conflicts of interest.
