Loophole
I would argue it till the damn cows came home. I don't care what kind of bonus the employees received. The facts are as I believe them had Nokia, and even Motorola, but had Nokia licensed IDCC for 3G as a early licensee, that not one licensee would have the low rate they have. That the fact that the employees received bonuses, it only shows that due to the lack of Nokia signing that to get anyone to sign was a major accomplishment, as Nokia was trying to break us. I would do my damdest to make them provide every amount they was charging for their patents and what they paid QCOM for 2G and 3G and try to get those as frandly.
What do you think a essential patent is worth? Would you say 1/2% would be reasonable? Would you say 1/10th of 1% is reasonable? Just what is several patents and at least 1 be essential is actually reasonable? You tell me and tell me what rate and why QCOM and Nokia's patents are worth more than a IDCC essential patent. If you was in business and your first custmoers was able to buy the product cheap, and as your product was bought by more do you maybe raise your price, or sell it for the same as you did 10 years ago?
I know I am not a attorney, but damned if I like to get ran over by anyone. I see nothing but strong armed tactics to me by Nokia, and their tactics has worked and is working. Apparently if IDCC will take .01 cents a phone you apparently will be content. I am willing to fight the sob till the cows come home now as IDCC has money and I believe to be right in asking for a reasonable rate from Nokia and one that is higher than anyone else as they are and have been the biggest THIEF.
