Perhaps the patent under application is determined by Bio to be in violation (whether it really is or not) of an existing patent they rightfully own, which would be silly to do unless there was real fear that it might not get denied.

In other words, maybe this Bruno character has filed a patent for a superior product with MCCY that goes around an existing patent he helped create with Bio. I have seen it happen before.
