I too was very encouraged and impressed when Barrett (I think you're right that it was her) said she didn't understand why they took up the case but for four of her colleagues. There were several things about this that made me really happy. First, I hope this means that ONLY four of the justices wanted to take up the case. I suppose it's possible that six or eight justices want to take up some cases. And I don't know whether the justices are aware of exactly how many of them vote to take up a case. But if she knows it was only four, that's great news. It was also great to hear her speak so forcefully because if she was willing to say something so sarcastic and dismissive and borderline mocking in public, imagine how strongly she'll speak when they're all debating the case among themselves in a room. Now we know we will have one very vocal advocate for Amarin's viewpoint in the meeting of the judges. So now there's a chance that one of the other five judges necessary to flip the Federal Circuit won't decide to do so, especially after the Amarin lawyer sounded like the most intelligent attorney facing the justices today. And not by a close margin!

If there was a disappointment for me, it was Sonia Sotomayor. She suffers from diabetes and she doesn't realize how generics killed Amarin in America and probably prevented thousands of people like her who could benefit from the drug from ever hearing about it.
