TTE, I think we are getting ahead of ourselves on this lawsuit. Yes, there is strong potential for positive outcomes. But talking about bankrupting Hikma seems a little premature. We haven't even finished Discovery.  If Hikma felt they were at THAT much risk, they would have stopped selling IPE and/or settled long ago.
My guess is that Hikma believes they have a stronger case than many of us believe they have.
Remember, we are not privy to any Discovery. We have no idea what either side is finding.
And as many have stated, even if Amarin prevails, Hikma could wrap this up in appeals for years before a dime is ever exchanged.
Now, the optimal outcome is a quick trial, we win, and the court decision invalidates all generic authorizations. And they execute an injunction based on the decision which effectively shuts down the generics until all appeals are exhausted.
But who knows what will happen.
