I think Tony is grasping at straws and is in for a big surprise.  This company was long before in the crapper before this kid came along and Tony is just trying to piggyback off his poor business judgment by taking advantage of the situation at hand.  I say Tony loses big time do to the fact the judge reviewing the case will find all these shortcomings and refer it to another court for investigation after he makes his judgement on this case.  Not good for APRU as far as I am concerned but it's just my opinion.
