As long as he still controlled the shares, that effectively means he didn't "sell". So yes, transferring shares between accounts may have required "technical" sells, but if he immediately re-bought in other accounts, then he still maintained control.

I personally believe that Sarissa is the one that has maintained the short position over time, but really no way to prove that. I just look at the short interest that has existed through every price point of the stock the past 12-18 months, and I can't imagine why someone (other than Denner) would not close their short position when the SP got down into the 0.40's. I think the short position served two purposes; one, it made him some money. But more importantly, it allowed him to control the price over time.

The short interest has hovered between 16-20M shares without fail, for the past year. And for most of that time, it was between 17M and 18M shares, even as the share price cratered. It just doesn't make much sense why any reasonable investor would still have that position open.

And I suspect, when Denner wants the stock price to start running, you will see that short position start to evaporate.
