I also think Denner has other options to get over $1 beyond this (if the joint venture thing didn't happen). And I don't think anyone in their right mind wants to take a $1.30 BO other than newer investors with super-low cost basis.

I think a $1.30 private bid would get him sued by shareholders. Anything under $5 is insanity. Current revenue projections should have us at $5 already.

A $1.30 private bid from Sarissa would have investors screaming to find out exactly how the stock was shorted down to $0.40.
