The 6-5 count was a party-line, worst case, scenario for 3M. Currently there are seven conservative judges of which four were appointed by Trump so we know those four judges are Federalist Society approved. The other three conservative judges were appointed by Bush 41 or 43. One of those judges is 84 so it's possible this judge may retire. In that case Biden could possibly appoint two additional judges to that court as there would be two vacancies; the one that currently exists and the one vacated by the 84 year old judge. Hence 6-5.

A quick search on Justia shows that some ambulance chaser has filed thousands of individual cases in the 11th Circuit. All of those cases site the cause of action as 28 U.S.C. § 1332, or a case where the defendant is requesting more than $75,000 in damages and in these cases for product liability. Cases above $75k can avoid lower courts.

Not against 3M but just yesterday there were 820 new lawsuits filed in the federal system. Welcome to lawsuit happy America.
