3M—My understanding is that the case will initially be heard by a 3-judge panel, so 3M is aiming for a 2-1 (or 3-0) decision. If the initial decision is adverse, 3M can request an en banc rehearing.

In the event of an en banc rehearing, I don't follow how you arrived at a projected 6-5 vote; please elaborate. TIA
