Just a reminder for those who might have missed it. Yesterday, on December 14, 2021, notice of appeal was filed against a June 14, 2021 non-final rejection of the combination patent application. (DCVax-l + Keytruda)

This is very rare, in that typically someone pursuing a patent waits for the next final rejection of the patent.

FWIW, my guess is that NWBO believes they now have an airtight case to argue for the patent grant, and they also believe time is of the essence.

An appellate brief should be filed within the next two months, perhaps earlier. A trio consisting of the patent examiner, a fellow examiner and a patent office supervisor will the meet to see if they agree with this peremptory (forthcoming) brief. If not, they will continue the appellate process by sending it to the board.

Either way, I see this as a positive move by NWBO.
