Hoffman, sorry to go back so far in time and to revisit this conversation about premarket promotion yet again, but I got a private message that I just read which made me go back and reread posts from that day. You said…

First, your statement is not accurate. While I freely admit that I am not an attorney that does not mean that I do not listen closely to what attorneys have told me and comprehend their legal interpretation. I have quite a significant basis to opine in this situation. This is not my first or second rodeo in the premarket promotion space and almost everything I do requires legal approval, so I believe that I have a degree of clarity on this subject and am willing to share my opinion on a message board, under an alias with all the caveats that entails. I have previously provided caveats which I will repeat for you again and now add to it just for you at the bottom of this message. I am wondering however if you are using an alias, and if not would request that you call me. Figure it out, you may have worked for me.

As well, FDA regulations are usually fairly general and their interpretation of them is learned through their enforcement actions. If you would like to do your own research, I believe FDA posts these actions which you can sift through yourself. Please get back to me when you do as I am interested in your opinion of what I have learned from several experienced industry attorneys over a number of years, both conservative and more open to risk. In fact, I spoke with one recently about this very advertisement as well as some other industry professionals that are quite knowledgeable about this very situation. Here is the summary…sometimes small companies make very big mistakes and FDA may or may not choose to enforce it and may or may not apply their full authority in doing so. They are not alone in the world, however, they have competition which can and usually will make a formal complaint. I personally don’t see LP taking that risk this late in the game after being careful and meticulous about so many things.
