marjac, I have not had a chance to read it yet, but let's assume for a second that the Appeals court finds that DU was wrong rule 24 and rules in your favor. How likely is it that they address the merits? Is it a foregone conclusion that send it back to her to rule on the merits or could they address them? Assuming they send back to Du to address the merits...do they get to send in another brief to address the merits? I am going to assume they get it sent back and get to address the merits in another brief. I hope you tell me different.
