I have not had the opportunity to review in detail, but what I find most interesting, is that they again chose not to address the underlying merits. Instead, they devote the entirety of their Brief to Standing and Rule 24 Intervention.
They state that because Judge Du did not dive into the merits, those arguments are not properly before this Court on Appeal, with the caveat, that if the Court reverses on Standing and Intervention, the case should be remanded back to the District Court, rather than deciding the case on the merits. I appreciate their acknowledgment of the possibility of reversal. :)
