The patents are either valid and infringed, or they are not. The Non Practicing Entity status won't mean much to the jury, IMO. Plenty of NPE's have won at trial. The inventors will show clearly their patents were infringed, but anything can happen at trial to cloud that issue. There are multiple dragons we need to slay at trial, and I think a NPE issue is down the list.
