Gbert, Your solution to the problem is simple and rational. For that reason I don't think the court will see it that way. The hatch Waxman bill created a flawed system. The supreme court will need to sort this out eventually. I think the GSK v Teva decision might represent a change in the thinking of the court. Patent law should not be violated in order to give unfair advantage to generic companies. Our R-IT patents are solid. The generic companies are infringing. We need to see how Hikma responds to the suite.
