In this case a merger would seem the way to go for li, Apple does not want this to happen, lqmt could close the doors and force Apple, on the other hand Apple could just build another lqmt
Given the current political climate, I doubt that a merger between Eontec (or any other of Li's Chinese companies) and LQMT is likely in the foreseeable future.
I don't see "lqmt ...clos[ing] the doors" as providing any leverage against Apple. Apple's rights under the MTA are in perpetuity and don't go away merely because LQMT closes its doors or ceases to exist.
IMHO, I think the best thing for LQMT is to proceed without Apple. Get some contracts outside of CE, prove that DC105 is a viable/valuable formulation, show that LQMT will survive and prosper with or without Apple, obtain rights to DC105 in the field of CE after the expiration of the ROFR, and after all of that, reenter into negotiations with Apple from a stronger position. As we are doing all of the above, Eontec might be working with other manufacturers in CE, which might bring Apple back to us (or to Eontec, which probably doesn't help us).
