viper, ... Webb did say that unless Edwards, not NevWest, did something illegal, it is hard to see what conclusions the NASD believes NevWest should have drawn by Edwards turning up on its doorstep with all those shares.

But, that's just Webb's opinion. And, NASD specified the red flags and why they were violations in the complaint.

I'm no expert on securities or Patriot Act law, but if 35% of my business came from selling CMKX shares (some of which didn't match up to the accounts Edwards says they should have gone into), I'd get a little nervous about what I was doing.

Strong case? Weak case? The NASD can't send people to prison. But, the DOJ can. And, the case that will be brought by the DOJ is the one that matters.

I wouldn't take odds on the principals of NevWest staying clammed up. Would you? ... eom
