Looks like the case will be dismissed in January - so why add unnecessary litigation?

No, it looks like the stay will be lifted and the case will start to progress forward again,

At that point there will likely be a motion to dismiss by Toucon/Cognat/LP and likely a counter motion. The could go back and forth.

After several months the Judge would rule on that, and I do not see why it would be dismissed. if not dismissed, we would discovery then finally setting a trial date. I doubt this plays out anytime soon.

What is your basis for assuming the case will be dismissed? To dismiss the case, the Judge must decide that even if the facts are as the plaintiff alleges, their is no cause for action.
