I would have handled the Nok matter differently with respect to past usage. I also would have established a minimum yearly payment beginning in 2002 until the rates could be set. I would have taken Ericy to the courthouse door if necessary to set a rate consistent with the rates contained in the original Japanese licenses. I would have struck a higher back payment with a longer term payout. I would have made sure that Sony paid an amount on its own for example to the other onlookers. I would have certification from a well respected 3rd party that the following patent claims covering air interface layers 1, 2, and 3 are essential to the following modes of 3g. I think the third party verification by itself would drive the share price significantly and would attract industry analysts.
