Netlist was also not allowed to use any of the nuances about working with a criminal company. The jury did not know that one purpose of the contract (implied) was for Netlist to receive value in exchange for Samsung using their patents. Also the clause in the JDLA stipulating disputes must use NY State contract law protected
Samsung.

Netlist won the case of BOC.

So the consequences from the judges ruling that Samsung breached are still intact. $23 MM, no license and maybe the Tax issue. Also Samsung admitted to infringing.

What I see here is even money/influence/delays cannot stop a trial. Will S settle? We won’t have to wait long now to find out. Can they argue whatever the jury decides? Sure, but that too has a times up moment. S behavior has been so ridiculous and obvious their arguments have less and less staying power.
