It's not Judge Lynch who would worry about the publicity. Why would he even care? As for Congress and Senate, this is an election year. Why would they want anything to do with a twerp CEO that is openly defying a court order? Giuliani's association with Kerik became an issue, so why would any politician give ammunition for their opponents to capitalize on?
Nobody should expect Altomare to take this position as this would be going above and beyond the call of duty, but I do think that Altomare is capable of such a sacrificial feat.

Developers of the failed Bahama Island and Crystal Palace condominium projects here say they fell for a financier's story about foreign bonds because they didn't fully understand how the purported global banking transactions worked.
Tommy Hix and Jeff Shoup, partners in T&J Development of North Myrtle Beach, say they gave Duwayne Woods $5.7 million in buyers' deposits because Woods said his Atlewa Trust company could finance construction of the condos through a foreign bond it held on Euroclear, a securities clearinghouse based in Belgium.
Woods, whose last known address was in San Diego, took off with the deposits but never provided the financing, according to Hix and Shoup.
Hix and Shoup, who live in Briarcliffe Acres, say they have not been able to contact Woods since February or recover the missing money.
Woods' assistant, Melissa Smith, stated in an e-mail last week that Woods "is not interested in discussing this matter with you."
Shoup said Woods showed him documents in mid-2006 purportedly showing Atlewa Trust had a bond registered on Euroclear.
Shoup said Woods told him and Hix that he had $100 million in financing for condo projects, and that the bond would be the source of that money.
Shoup said he was not familiar with Euroclear and foreign bonds, but the documents looked legitimate.
"Everything was so believable, and I wanted to believe," Shoup said.
Shoup said Woods told him he didn't want to finance the condo projects through a Wall Street bank because it would take too long.
"He told us he could do it much quicker through Euroclear, because the Euro is stronger than the dollar," Shoup said.
Shoup said he and Hix checked with bankers they know to make sure the funding process Woods described to them was accurate.
However, the developers never checked to see if Woods' story was legitimate, Shoup said.
"We verified that's the way it's done," Shoup said. "We did not verify what Woods was doing."
Denis Peters, Euroclear's director of corporate communications, said trusts are not allowed membership in Euroclear.
"Trusts are not active enough in foreign capital markets to warrant direct membership in Euroclear," he said.
That means Atlewa Trust would not have been able to issue its own bond on Euroclear.
Peters said it is unlikely a single entity, such as Atlewa Trust, would have full ownership of a bond that had been issued by someone else.
"I can't imagine that an issuer would want one single investor to own a bond that would be made available for public trading," Peters said. "If an entity wanted to raise capital, and identified one investor, then they would more likely do a private transaction with that party."
Woods seemed so knowledgeable about foreign bond transactions, Shoup said, that the developers "believed that what he was saying was the truth."
Shoup said Woods kept making excuses when financing didn't come through.
"He kept having issues with the bond," Shoup said.
The foreign bond scenario is similar to what happened during the same time frame at another company where Woods is affiliated, according to the Securities and Exchange Commission.
A Dun & Bradstreet report lists Woods as chief operating officer at Conversion Solutions Holding Corp., an Adairsville, Ga.-based public company that claimed to own foreign bonds traded on Euroclear, according to court documents.
The SEC is suing Rufus Paul Harris, Conversion Solution's chief executive, over an alleged pump-and-dump stock scheme in which the federal agency says Harris promoted false ownership in foreign bonds to boost the company's share price.
Harris denies the allegations in court filings and the lawsuit is pending.
Harris and Woods are longtime business partners, court records show.
The two men formed Atlewa Trust in 2004, along with former Myrtle Beach resident Ancil Garvin.
Harris, Woods and Garvin are defendants in lawsuits filed against Bahama Island's developers on behalf of investors who lost millions of dollars in deposits.
Conversion Solutions claimed in September 2006 that it had full ownership of a Venezuelan bond on Euroclear that purportedly was worth 5 billion euros, according to court documents and the company's SEC filings.
While the bond did exist, an SEC investigation showed it was worth 700 million euros and Conversion Solutions never had full ownership, if it had any ownership at all.
The same was true of a separate $500 million Venezuelan bond Conversion Solutions claimed to own, according to the SEC.
Harris, whose last known address was in Adairsville, did not respond to an e-mail seeking comment.
Harris said in October that he met with Woods in early 2007 to talk about Atlewa Trust's purported Euroclear bond.
Woods "said he had $750 million in bonds loaded on Euroclear and he wanted me to help him find investors," Harris said.
Harris said the bonds were supposedly backed by real estate projects in South Carolina, Florida and Baja, Mexico.
Most U.S. investors are not familiar with Euroclear, according to the SEC, and it is difficult to verify claims made about foreign bonds at the securities clearinghouse because Euroclear requires a password that is available only to member organizations.
"No individual could become a member of Euroclear," Peters said.
"Only financial institutions that meet very strict criteria can become members."
Dozens of lawsuits have been filed against Hix, Shoup and others on behalf of Bahama Island and Crystal Palace buyers who lost money.
Shoup said he hopes the pending sale of the land where Bahama Island was supposed to be built will raise enough money to pay back those investors.

Quick information
Crystal Palace was supposed to be a 35-unit oceanfront condo tower built on two lots in the 900 block of South Ocean Boulevard in North Myrtle Beach. About $600,000 in buyers' deposits is missing from that project.
Bahama Island was supposed to be a 320-unit condominium and marina project built along the western bank of the Intracoastal Waterway. About $5.1 million in buyers' deposits is missing from that project.
National Bank of South Carolina is foreclosing on the Bahama Island land because the developers have not made payments on a $7.7 million mortgage they received.
Developer Jeff Shoup said he hopes there will be enough money left over from the sale of that property to pay off the mortgage and refund deposits to Bahama Island and Crystal Palace investors.
Shoup and partner Tommy Hix marketed the condos through their Oceanfront Real Estate Co., which transferred the deposits from an escrow account to Woods.
By last February, the Bahama Island and Crystal Palace deals had collapsed and Woods and investors' money had disappeared, according to Shoup.

yeah, those scum bags picked the lock on my door while i was in the hospital with pnemonia a few weeks ago, they changed the passwords on my computer and wiped out my pics i had stored there, they stole my hard copies of the pics and docs i sent the fbi....cause i have a civil suit against the scumbags coming to trial very soon.....

It is not strange at all. Judges do not appreciate accusations of being involved in some conspiracy with the SEC, or any other Government agency to bring down a corrupt business or their officers, etc. Judge Lynch's decisions were based on the facts presented to him.
What you should find strange are the comments by delusional shareholders, including the threats that were mention in Judge Lynch's courtroom.

Woods played the part of an international investor with deep pockets and a lot of clout, and his stories and paperwork seemed to check out, according to Brittain.
"As it turns out, it looks like none of that was a legitimate enterprise," Brittain said.
Harris, of Adairsville, Ga., helped Woods form Atlewa Trust, the company that was supposed to finance Crystal Palace and Bahama Island. Harris is being sued by the Securities and Exchange Commission over an alleged pump-and-dump stock scheme he orchestrated.
Harris told The Sun News in October that the timber deal fell through and he severed his ties with Atlewa later that year.
Atlewa seemed to be the culmination of years' worth of questionable business practices for Woods and Harris, according to court documents and the SEC.
Harris told The Sun News in October that he and Woods had a falling out in the months after Atlewa was formed and that Woods left Waatle to do business on his own using the Atlewa name.
Lawyers representing Bahama Island's buyers, however, say they think Woods and Harris might still be doing business together.

2nd condo project languishes
Financier and investors' deposits missing

Investors' money is missing from a second failed condominium project here, and a familiar story is emerging of an elusive financier who local developers say took off with millions of dollars in condo deposits, never to be heard from again.
About $600,000 in deposits for the oceanfront Crystal Palace condo project has disappeared, according to court and S.C. Real Estate Commission documents.
Tommy Hix and Jeff Shoup, the would-be developers of Crystal Palace who live in Briarcliffe Acres, say purported financier Duwayne Woods took that money and $5.1 million in deposits from another project.
Hix and Shoup, who do business as T&J Development, say Woods promised his Atlewa Trust company could finance the condo projects.
Hix and Shoup gave the deposit money to Woods, but Woods never funded loans for the projects, Shoup said.
Hix and Shoup said they have not been able to contact Woods since early last year.
Woods did not respond to an e-mail seeking comment and he did not return a message left at his last known telephone number.
Woods' assistant, Melissa Smith, said in an e-mail Friday that Woods has been in contact with Hix and Shoup and the men "have an agreement and an understanding."
Smith said the deposit money Hix and Shoup gave to Woods was to repay loans Woods had made to the two developers.
"Mr. Woods did not steal any money from anyone," Smith said. "T&J Development made payments on several outstanding loans that were due to Mr. Woods."
Shoup said Smith's comments are not true. He said T&J did not owe money to Woods and "we have not had any conversation with him."
The Crystal Palace tale mirrors events at another failed Hix and Shoup project called Bahama Island Resort and Marina.
In that case, Hix and Shoup say Woods took $5.1 million in buyers' deposits, which were supposed to be held in an escrow account.
The missing money might represent one of the Grand Strand's largest real estate scandals, but there are indications the problem isn't limited to this area.
Investors in condominium projects in Florida, Nevada and Baja, Mexico, might have met with the same fate, according to documents obtained by The Sun News.
An investigation by The Sun News shows the local condos and those in other states are the latest venture for Woods, who is connected to a web of shell corporations with dubious finances and counts penny-stock promoter Rufus Paul Harris among his business partners.
Harris, of Adairsville, Ga., helped Woods form Atlewa Trust, the company that was supposed to finance Crystal Palace and Bahama Island. Harris is being sued by the Securities and Exchange Commission over an alleged pump-and-dump stock scheme he orchestrated.
Woods lived in Adairsville until the end of 2004, according to property records. His last known address was in San Diego.
The series of events and cast of characters that led to the condo failures might read like a fiction novel, but investors say their pain is all too real.
"I know I'm probably never going to see my money again," said Thomas Lewis, a New York resident who in January 2006 gave T&J Development a $37,495 deposit on a Crystal Palace unit.
Lewis recently spent a week in North Myrtle Beach trying to get law enforcement agencies to investigate the missing condo money.
"No one wants to help," Lewis said. "I can't understand that. If I were to go into a Wal-Mart and steal something, they'd put me in jail. But someone steals thousands of dollars in a real estate deal, and nobody cares."
The Crystal Palace deal
Crystal Palace was supposed to be a 35-unit oceanfront condo tower built on two lots in the 900 block of South Ocean Boulevard.
Hix and Shoup marketed the project through their Ocean Front Real Estate agency in North Myrtle Beach, and they touted Crystal Palace as having "super, ultra high-end" units with "views that will take your breath away."
Prices ranged from $649,900 for an interior unit to $2 million for a penthouse suite, and buyers were required to pay a 10 percent, nonrefundable deposit to reserve their spot in the building.
Those deposits were supposed to be kept in an escrow account until the project was completed, according to S.C. law.
Instead, the developers gave the money to Atlewa Trust, according to Conway lawyer Ronald Norton.
Norton is representing four Crystal Palace buyers who lost a combined $298,000 in deposits.
Shoup said Atlewa Trust was given the money because that company was supposed to be the source of funding for the condo projects.
Robert Gwin, a Myrtle Beach lawyer representing Hix and Shoup in the Crystal Palace case, did not return telephone calls to The Sun News.
Bahama Island was a more ambitious project, with a planned 320 units and a marina to be built along the western bank of the Intracoastal Waterway.
Atlewa Trust was supposed to finance that deal, too, but the only construction that took place was for a dry-dock storage building that now sits empty on the property.
National Bank of South Carolina is foreclosing on the Bahama Island land because Hix and Shoup have not made payments on a $7.7 million mortgage they received along with business partners and Grand Strand hoteliers Bhupendra Patel and Pradipkuman Patel.
Shoup has said he hopes there will be enough money left over from the sale of that property to pay off the mortgage and refund deposits to Bahama Island and Crystal Palace investors.
Lawyers in the Bahama Island case say an unknown buyer has offered $18.5 million for the property, which should be enough to pay off the debts, but it is not clear when that transaction will occur.
Woods' proposals
Shoup said he and Hix met Woods after Woods made an unsolicited offer to buy out their Crystal Palace project.
Woods never followed through on that plan but did tell Shoup and Hix his Atlewa Trust had $100 million to loan for condo projects, Shoup said.
"He asked us if we wanted Atlewa Trust to finance Bahama Island," Shoup said.
Woods also agreed to finance Crystal Palace.
Woods "seemed at the time to be a man with the wherewithal to finance the project," said Conway lawyer Tommy Brittain.
Brittain is representing Hix and Shoup in lawsuits filed against them by Bahama Island buyers.
"They needed someone who could get a lot of money to get the thing going," Brittain said.
Among the purported source of Atlewa's funds were bonds Woods said he could place with Euroclear, a securities clearinghouse based in Belgium.
Woods played the part of an international investor with deep pockets and a lot of clout, and his stories and paperwork seemed to check out, according to Brittain.
"As it turns out, it looks like none of that was a legitimate enterprise," Brittain said.
Woods helped form Atlewa Trust in July 2004 with two of his longtime business partners - Harris and Ancil Garvin, a former Myrtle Beach resident.
The three men had been involved in a series of business failures, some of which led to federal lawsuits, before they teamed up to form Atlewa.
The trio and some of the companies they have formed are named as defendants in the Bahama Island case because lawyers think some of the missing money might have found its way to them.
Woods' background
Atlewa's initial asset was supposed to be a $175 million timber deal with Aspire Holdings LLC, a Miami company that had no known assets when it was incorporated in February 2004.
Harris told The Sun News in October that the timber deal fell through and he severed his ties with Atlewa later that year.
Atlewa seemed to be the culmination of years' worth of questionable business practices for Woods and Harris, according to court documents and the SEC.
Prior to Atlewa, Harris had been an officer in Enhancement Holdings LLC, a shell corporation formed in Surfside Beach that wound up in federal court when a merger partner accused Harris of fraud, negligent misrepresentation and breach of contract.
Harris, who went by the name Paul R. Harris at the time, claimed Enhancement had $100 million worth of insurance guaranty bonds. He used those bonds as an incentive to get Broadband Wireless International Corp. to agree to a merger with his company, according to court documents.
Broadband, which was emerging from bankruptcy at the time of the merger, later claimed in court papers that the bonds were backed by insolvent companies in the Philippines and proved to be worthless.
Broadband dropped its lawsuit in January 2005 after it became clear that Harris and his Enhancement partners had no assets, court documents show.
Before that lawsuit was dropped, Harris had teamed up with Woods to form another company called Waatle Corp.
Waatle had one asset, according to the Securities and Exchange Commission - a purported $170 million bond backed by phony real estate liens.
The two men and Garvin also formed Atlewa, which is an anagram for Waatle, to carry out the purported timber deal.
Harris told The Sun News in October that he and Woods had a falling out in the months after Atlewa was formed and that Woods left Waatle to do business on his own using the Atlewa name.
Lawyers representing Bahama Island's buyers, however, say they think Woods and Harris might still be doing business together.
Harris ran into more legal trouble in 2006 related to a publicly traded company he formed called Conversion Solutions Holding Corp., which merged with Waatle and took on that company's bond backed by the phony real estate liens.
The cowboy hat-wearing Harris, whose colorful image included business meetings at Hooters restaurants, had a devout following among penny-stock pickers on Internet discussion boards.
Harris and other Conversion Solutions executives used those discussion boards and news releases to tout a wild array of assets, including nearly $8 billion in foreign bonds and the rights to harvest all of the logs at the bottom of the Amazon River and its tributaries.
Harris said his company's bonds were listed on Euroclear, the same foreign bank Woods said he could use to finance the North Myrtle Beach condos.
Conversion Solution's assets appeared too incredible to the SEC, which halted trading of the company's stock in September 2006. The agency later filed a civil lawsuit against Harris, accusing him of trying to artificially inflate his penny stock's share price.
Harris denies the allegations and the lawsuit is pending.
Deals collapse
Financing never was provided for Bahama Island, Brittain said, although documents show Woods tried to make the deal work through a proposed series of unconventional real estate transactions.
Conway lawyer Richard Lovelace outlined Woods' plan in an Oct. 17, 2006, e-mail to Smith, Woods' assistant. That e-mail was among Atlewa documents obtained this month by The Sun News.
Lovelace said in the e-mail that Woods wanted to hold real estate closings on each of the Bahama Island units, even though none of the units had been built, there was no legal deed for the property and none of the buyers had agreed to sign mortgages for nonexistent condos.
Lovelace told Smith the plan was illegal and that he would not help Woods with the false real estate closings.
Lovelace would not comment on the e-mail or why Woods wanted to obtain closing documents for unbuilt condos.
Harris, however, told The Sun News in October that Woods was trying to find investors for bonds supposedly backed by mortgages on real estate developments in South Carolina and other states.
"He said he had $750 million in bonds loaded on Euroclear and he wanted me to help him find investors," Harris said.
The bonds would have been difficult to sell without closing documents indicating the projects were already built.
Lovelace, who specializes in real estate law, said he doubts Woods' plan would have worked anyway because bond investors would have required title insurance and appraisals on each unit, something Woods could not obtain.
Without title insurance and appraisals, Lovelace said, investors would run the other way.
Lovelace spent four months trying to find a legal way to make the Bahama Island deal work, according to the Atlewa documents.
Finally, in late October 2006, Lovelace told Woods in a face-to-face meeting in Conway that he would not help him with the proposed real estate closings.
"I told him we have nothing further to discuss," Lovelace said.
Lovelace said that was the last he heard from Woods.
The project languished without financing for a couple more months before buyers started asking for refunds of their deposits.
By last February, the Bahama Island and Crystal Palace deals had collapsed and Woods had disappeared, Shoup said.
A series of lawsuits have been filed in both cases and state regulators permanently revoked the sales license for Ocean Front Real Estate's broker, but law enforcement has declined to investigate any possible criminal activity that might have taken place.

The voting tallies, if you go town by town in New Hampshire before the final tallie was calculated, shows Ron Paul won the primary. However, with a dismal showing, McCain was declared the winner. I imagine that Hillaryt got a similar "boost" from the vote counters.

well, i have a guess...
Maheu was the TRUSTEE for DISTRIBUTION and he didn't authorize DISTRIBUTION....
instead, the DTCC was exiting their vault remember, and by Special Memorandum, there was an internal DTCC budgetary code, i believe that code related back to the WANTA money....Maheu and Son then learned of the WANTA money/intervened to negotiate a better deal....which is LIKE KIND and QUANTITY....so says REG SHO....
again, i only know the part about the DTCC exiting their vault.... i made a few phone calls to the DTCC, referencing what i knew to be true...prior to them alerting tdameritrade of the cash coming....then it was stopped, so you have my best guess.

Without saying anything to the one helping with this test procedure, or the reason for it, the test determined that that which was being tested HAD NO CONSCIOUSNESS and was ONLY AN IMAGE or a LIKENESS OF SOMEONE OTHER THAN HENRY PAULSEN. ok, well let's review some facts!
April 2006, we were about to be paid by the DTCC...that was stopped by i presume Maheu...
June of 2006 Bush fired Sec of Treasury John Snow and replaced him with his buddy, Henry Paulson
June of 2006 the 4.5 trillion was sent to U.s. Treasury for LeoWanta.......Bush did intercept this money and put it in an account under his name...in a virginia bank....i heard that from an unconnected person who knew of this 4.5 trillion account in Bush's name via his hacker-friend who used his mother or grandmother's fbi "code/password" to hack into this virginia bank...while snooping around this kid accidently found this huge account...and he told everybody he knew about it, that's how i knew the money existed for real in the spring of 2007.
So, now we have Paulson, who had control of this money for over a year moving it around everywhere, who knows the cash is stolen, so greed gets the best of him too, and he decides it's his....so he blackmails bush for a share and soon paulson gets shot....don't know about you, but i think it's all very real...
one thing i noticed about the paulson "image" is that he continually made a triangle with his thumbs and first finger right over his stomach area......in past videos, i never saw paulson do that...it's almost like he was garnering energy....dunno, but it was very noticable.
so, each has to believe what they understand.... i know Bush stole the money in the first place, so i doubt very seriously he is going to allow anyone to steal it from him.....without a fight!
bottom line...all the money in the world is not worth murdering over, you do murder you live in hell for an eternity.....that's not too bright in my book....on balance, the money isn't worth the price of eternal life.

Ron Paul: Friend of Stock Scamsters
Republican presidential candidate Ron Paul has been making a lot of noise lately for being in the very uncommon position of being right. He was unfairly excluded from a Fox News debate Sunday night.
But before you shed too many tears for Paul, or even bother to read through his ultra-right position on the issues, there's a couple of things you may want to peruse. Seems that Paul has a long history of promoting bigotry and a more recent, equally creepy record of climbing in the sack with corporate cretins.
First read the devastating exploration of Ron Paul's bigoted past in the New Republic website today.
Then peruse Paul's ringing endorsement (see left side of page) of a book by a stock promoter named Anthony Wile. But be sure to read that slap on the back with the SEC press release charging Wile with stock manipulation.
No surprise there, given Paul's generally half-baked worldview, and neither is his endorsement of beefed-up SEC rules against the phantom menace of naked short selling. That is contrary to his smaller-government ethos, but in league with his sympathy for stock scamsters.
Another sleazeball to be embraced by Paul is Overstock.com's SEC-investigated CEO Patrick Byrne. The loopy Byrne, famed for his stock market conspiracy theories, recently used Overstock corporate resources to tout Paul's candidacy.
Said Byrne:
In October Dr. Paul came to Utah, and he and I visited for an hour in my office. After that meeting, I gave him the largest donation I could under federal law: it is rare to meet a politician who understands the Constitution, and rarer still to meet one who thinks it binds the government meaningfully (I would give Dr. Paul more were there not now a federal blackout on free speech known as “McCain-Feingold”). In a television interview last week I stated that, while for the first time in my life I felt there are several candidates qualified to be president, my #1 choice would be Dr. Paul.
No surprise here either, as the notoriously paranoid Byrne has found a kindred spirit. The New Republic article today observed that "Paul's newsletters didn't just contain bigotry. They also contained paranoia--specifically, the brand of anti-government paranoia that festered among right-wing militia groups during the 1980s and '90s." The stock market conspiracy websites supported by Byrne are hotbeds of paranoid rants and anti-government nuttiness, along with the usual stock touting.
Paul's history of racially tinged comments has raised eyebrows even before the New Republic article, such as this blog by black conservative Bob Parks.
I imagine that more than a few Overstock customers would not appreciate getting a political spam such as that email, particularly on behalf of a candidate with a record of extremist positions and, according to the New Republic article today, a "bigoted past." Even without knowing that, no doubt many Overstock customers are offended by Paul's position on the Iraq war, and his view that U.S. policies prompted the Sept. 11 attacks. Hardly the kind of person most companies would want to flaunt before their customers.
But what the hey, Byrne is not a perennial on "worst CEO" lists for nothing.

Urban appoints Kevin CEO of CMKX knowing there is a Wells Notice that he has ignored and once again avoids accountability (for now). Now look who is stuck dealing with the SEC. Kevin stays at Urban's LV home and notes the fine furnishings and after Kevin leaves Urban immediately sells them cheap. The Godly man Urban may be dumb, but he sure is a good conman. Imagine being played over and over again by an ex-prison guard.

gusjarvis, having talked to Frizzell the other day, I do not believe he knew as much as you think he might of and his opportunity to do any real DD from the inside was very limited. According to Frizz, in retrospect, the only reason he was asked to join the task force was to keep him busy and out of the way while at the same time keeping him close enough so they could keep tabs on him. In addition, the shareholders trusted Frizz and if he was made to look like a trusted participant with the company, it would allay shareholder fears and keep them quiet and at bay for the duration. It was an opportunity Urban would use greatly to his advantage.
Bill now thinks that the cert pull was nothing more than a delaying tactic and despite assurances from Urban that an interpleader would be filed, one never was. As such, even Kevin's efforts on the interpleader were nothing more than a tactic to keep him busy and out of the way while also keeping tabs on him. Keep your friends close but your enemies even closer.
With those two out of the way, they could operate freely out of plain sight. Who is they? At least Urban of course but he isn't sure of the others. We know Edwards was involved up to his neck as well as several others. Some brokers were probably involved as well and there is evidence that several people on the boards were indeed plants, paid to pump the company and most of all, Urban and his "love" for the shareholders.

There will be a lot more people added to the Does and Roes before this is over. Frizz doesn't think Mahue was involved but may have been used, just as the judge suspected. Frizz and Mahue still talk from time to time and have a good relationship. It should have been evident to all of us that when Mahue stepped down as co-chairman but stayed on for the cert pull, that he was no longer there for Urban at that point and was only trying to do what he could for the shareholders.
There is evidence of Don working for people involved in prior scams but it is hard to say if he was party to the scams or just doing what lawyers do, protecting their clients, whether innocent or guilty. It is interesting to note though that once the cert pull was complete, Don and Mahue both left the picture and Urban then hired Moran, a criminal lawyer, not a securities lawyer, to represent him. It should have been obvious to all at that point that Don was not going to be helping Urban anymore and in fact their relationship had started to seriously deteriorate when Don refused to give up the Entourage cert because Urban had not paid him for his fees.
Perhaps Don and Mahue both realized what was going on early on and did what they could for the shareholders and then left before they could get dragged deeper into the mess. The reason neither of them have said anything since then could well be to protect their reputations as they would have to admit to being duped by a former prison guard and his cronies.
Additionally, they were both being assured by Urban that the required data was being provided to the accounts as was requested, when in fact this was not the case. Urban was lying to both of them on this issue and this became obvious in court when Mahue, who believed it was being provided, learned that it in fact was not. Remember, even Don's own hand picked accountant ending up quitting just days before the hearing because of evidence he uncovered indicating criminal fraud was being committed and by law, he was required to cease working for the company and report the information to the SEC.
Frizz told me that he was not privy to any insider information while on the task force and for other than task force issues, was kept out of all other aspects of the business. Same with Kevin. There were some very intelligent criminals involved with CMKX. Edwards is one well known example and he and his wife both have been the ring leaders of numerous con jobs. These people are professional criminals who make a plan and then work that plan. It would not be possible for them to carry out this huge of an operation without Urban knowing and being a party to it. Each step was carefully orchestrated with just enough hints placed out there to lead people off into the wrong direction, should they get suspicious and start looking deeper.

That is a correct assumption, however, the question needs to be asked to the committee and answered by same and/or counsel. Don't for one moment think that I am covering for any of the principals or in alignment with either, however, I do believe that one must approach this with logic and expect the questions to be answered. I would tend to believe that if either Taylor or Chris thought that their backsides were going to be in hot water due to Frank they would step up to the plate and tell all, for what it's worth.
