Ghors' all that I can add to this is it is not unusual for a judge to give one attorney a really bad time, but then hold for his client. Of course the easy way out for the judge is to stay the ll proceeding!Tucker
Ghor's , the art of instant communication is a thing of beauty to behold! It was not too many years ago that one had to rely on "daily copy" of court proceedings and overnight, if one was lucky, an attorney could get his expert to go over the day's testimony and help frame questions for the next day questions and cross-examination! Loop is absolutely right about the procedure. However, it is my belief that the hardest one to eduate is the judge as he would rather get his sleep than worry about the next day's testimony.
I also agree with Loop that we should not be where we are if Dallas Judge Lynn had not opened the box of horrors for Nokia to open up what should have been a non judicial event after the case was closed. She did not have jurisdiction, but her decision not to follow what was already established law caused the infringers to realize that stalling does pay off big dividends. In my opinion the case in England and Delaware are without merit and should have been thrown out of court a long time ago. As for the lack of ruling on the Samsung Award, the judge should have ruled on that within a very short time after the award.
Of course one has to wait for the wheels of justice to turn, but that does not mean that it is justice when it takes forever to turn the wheel. I am totally disgusted with the way the legal system is being abused by this endless litigation. My opinion-tucker

Spree99, Overtime-big time, The Houston Cabal is non-political, but if you took a vote , they would probably split down the middle; however, most members seem to be disapointed in George.
In answer to your questions, it must be understood that all of the members of the Cabal are very disappointed that Idcc has not yet lived up to its potential, but the members are hanging in there!
I believe that Gold will hold its own. Oil prices will continue to be high. I watched the dollar sink from it taling 98cents to buy 1 euro to now it is around $I.40 or thereabouts. My view is that the time will come when the World Monetary System will be pegged to the Euro because of our big deficits, trade inbalances and the fact that so many coutries are holding so much of the country's debt.
As for the question about Iran you will have to go to Crawford , Texas and ask George himself. You might have trouble finding the gentleman on his 1600 acre "ranch" that has only 5 cows and no horses, but many bike trails. Most people in our country believe the place to be a ranch, but Texans know that it is not and that it is a play toy for its owner who was able to buy the ranch with the 10 million dollar bonus he received when the Texas Rangers was sold to a group led by another gentleman named Hicks! At the time of the sale the owner of the ranch was the Governor of Texas.
Spree, I wish that I could have given you more factual answers about the ranch, but having been to Crawford Texas and having trouble finding a notary public to notarize a lease, I can assure you that you do not want to go there to live unless you want to be bored to death! Tucker

GHors', believe it or not I had the civil case delay excuse to give preference to criminal trials used in 1961 by the Federal Courts here in Houston. You would think that it would not take half a century to speed things up. One of my sons clerked for a Federal Judge in the 90ies and the same thing was still happening. So I will stick with the Old Adage that "Justice delayed is no justice at all!" I will not go into the work habits of the federal courts and their staffs! tucker

Loop, you are so right about there not being an adequate remedy at law for the small inventor to fight a mega international company that infringes! The ITC can help to level the field so that the Infringer can not bankrupt the small company with IP rights through litigation. I have seen too many examples of such happenings and , in my opinion, the slowness of the judicial system and the litigation expenses along with the courts that sit on cases for literally years,then take forever to rule is an absolute disgrace!
I hope that the Bush Administration stays out of the Qualcome matter and on August 6th does not veto the ruling of the ITC!tucker

Sailfreeee, ot--- Data Rox is a smart man but when one does not invite Arthritis from Tennessee , then he is making one big mistake! The Houston Cabal met and Raymond not only came to Texas, but he sold a "PIG" and bought all the drinks for the crowd of about 15, except the 1st round that Lurgio bought. He sold another "PIG" when he arrived home. Lurgio was invited but could not make it. He called from Chicago and had the restaurant put the 1st round on his credit card.

Ot Ghors, in my opinion, your advice to Loop is "Right on". I have 4 bulging disc and ,for me, surgery is something that I did not want to do based on the clients who have had fusions,etc. My doctor, a sport specialist, sent me to a pain doctor who sent me to a physical therapy specialist who prescribed back exercises and ,particularly, stretching exercises. This worked well for me as I have been a "Gym Rat" all of my life. I would recommend the same to Loop.tucker
Loophole, enjoyed reading your e-mail. As you and I have agreed from the beginning in regard to the Federal dispute about payment of the attorneys' fees. Idcc agreed to something and it was going to lose the dispute. I believe that all of the Institutional stock holders knew that Idcc's position was weak and have fully discounted Idcc's liabilty as to value when the stock was purchased; therefore, I do not believe that the price of Idcc's market value will really be lowered. Jim, I agree with both Ghor's and Loophole! The sad part of all of the litigation is that the result is that it hurts the small investor more than anybody else. Yes , justice delayed is justice denied and the delays and the total waste of time on matters that should be decided quickly is why I said enough is enough and quit handling cases 10 years ago!
The Delaware case should have been disposed of shortly after being filed. The case in England is just another example of a Judge overstepping his own juridiction and trying to decide something that he should not. The New York Court should have rendered a decision on the Arbitration with Samsung a year ago and the ICC allowing Samsung to file new arbitrations on a decided matter is just ridiculous.
A big part of the problems is that our Judges and hearing officiers complain too much that they are working too hard and pass the cases down to subordinates instead of ruling when they should.
I have been an Attorney for 50 year and the law has been very kind to me, but something needs to be done to speed up the disposal of cases. I believe that the biggest abuses of the system originate at the top and the biggest and richest litigants are able to take advantage of the system! I blame atttorneys also for letting the system be used as a delaying tactic to deny the small under financed litigants their day in court and justice to be served.

Ghors, you are absolutely correct in your assessment of what is transpiring in Idcc's cases against the giants. Our system is supposed to be geared to helping the lesser to stand up to the greater and have its rights swiftly protected. It just does not work that way in our justice system!
The old adage that "Justice delayed is Justice denied"! In my opinion, the Delaware case should have already been disposed of as being a "Trash" lawsuit to only delay and to help negotiations on behalf of Nokia. When the judge sanctioned Nokia, he should have thrown out the lawsuit as part of the sanctions. It is obvious that the Attorneys' action was in bad faith and that they knew the type of witness that they were producing. The Attorneys should have been sanctioned heavily.
I could go on and on as to how the system has been abused over and over as to Idcc's litigations, but that will not speed up the Samsung Case which should have been decided within a matter of weeks in order to allow Arbitration to work as it was intended to so do.
I do agree with Loophole as to Attorneys not being sanctioned for filing pleadings not in good faith!
In reply to Jum Lur, I can only say that , in my opinion, Loophole and yourself are damn good lawyers who have given this board good sound legal advice. Further, do not think that our lawyers do not enjoy the fees that are being generated whenenver NOkia,Samsung and others either bring suit or dig in their heels and continue to delay. Ghors, I do not agree that all of this litigation is "Due Process", but do agree with the Count that it is only justice delayed. The attorney are the ones making the money now with this stock and the endless litigation. Juat notice that in addition to other firms that Fulbright has both its Dallas office and Houston office signing off on the pleadings. Just imagime all of the "Billable Hours" in attornies' fees and support staff charges that Idcc is paying!!!!!!!!

Revlis, in an actual trial, the offering of speculative evidence is subject to objection by the opposing side and the courts that I have practiced before have been quick to sustain the objection and refuse the offering of speculative evidence!

What the court's ruling in Delaware does is put the burden of proof on Nokia and this is where it should be in the 1st place. What the ruling does is make Nokia 'shoot with a rifle" to support their cause of action as opposed to "shooting with a shotgun" and forcing Idcc to spend a great amount of time and money defending itself; also, the denying of discovery items protects Idcc from being forced to produce irrelevnt material!tucker

However, I am going to take the same position ,legally, that I took as to Judge's Lynn's opinion. Nokia has no basis for an appeal! Nokia is only buying time hoping that something will happen that will make it worthwhile to keep litigating.Hopefully soon there will be a court that will state enough is enough and sanction Nokia for filing an appeal without any real legal basis except the law allows them to do so!tucker

It has been my experience not to put too much weight in a judge's questioning of an attorney. Many judges will ask an attorney very pointed questions that seemingly are contrary to the attorney's position and then hold for the attorney's client.
Scalia's remarks about property rights were very strong and might cause the attorney for E-Bay to lose some sleep, but we will just have to wait and see how the decision reads before we will know if the remarks of Scalia really meant anything! tucker
