Ghors, you are absolutely correct in your assessment of what is transpiring in Idcc's cases against the giants. Our system is supposed to be geared to helping the lesser to stand up to the greater and have its rights swiftly protected. It just does not work that way in our justice system!
The old adage that "Justice delayed is Justice denied"! In my opinion, the Delaware case should have already been disposed of as being a "Trash" lawsuit to only delay and to help negotiations on behalf of Nokia. When the judge sanctioned Nokia, he should have thrown out the lawsuit as part of the sanctions. It is obvious that the Attorneys' action was in bad faith and that they knew the type of witness that they were producing. The Attorneys should have been sanctioned heavily.
I could go on and on as to how the system has been abused over and over as to Idcc's litigations, but that will not speed up the Samsung Case which should have been decided within a matter of weeks in order to allow Arbitration to work as it was intended to so do.
I do agree with Loophole as to Attorneys not being sanctioned for filing pleadings not in good faith!
In reply to Jum Lur, I can only say that , in my opinion, Loophole and yourself are damn good lawyers who have given this board good sound legal advice. Further, do not think that our lawyers do not enjoy the fees that are being generated whenenver NOkia,Samsung and others either bring suit or dig in their heels and continue to delay. Idcc is a "Cash Cow " that is literally being legally milked to death! tucker
