loophole was right as to what the court ruled, but I could never understand how the court reversed as to validity and affirmed as to the jury's finding of no infringment. Since the court ruled that the question of validity was a "law question" for the judge to decide and the infringment was a fact question, then since the jury had answered both against Idcc, how could the jury be expected to answer other than "no infringment" and declare something that was invalid could be infringed!! The court should have remanded for a new trial on the fact question of infringment.
I said Lynn was wrong, Batts was out of it and Sanders had just gotten too old and I now believe that Luckern also was just wrong and the appellate court will reverse! Just my opinion. Tucker
Yes , we will miss Raymond. Although he lived in Tenessee, he was a great "Roll Tide" fan! When he found out that I was from Illinois, but had graduated from Alabama and had connections still with many of the football crowd, he was most pleased and he claimed that it almost made me his brother!!! Raymond contacted me when he found out that I was an Alabama graduate. He happens to be a big fan of the Crimson Tide even though he lives in Tennessee. I met him when he came to Houston and financed the party with the proceeds from the sale of "Pork Bellies". He is a solid citizen and I will pray for his recovery.

ghors,I agree with your assestment of the legal system as to complex technological lawsuits and I would like to go one step further. I predicted that the Commission will review Luckern findings; however, the representation of Nokia by Aston and Bird does worry me because of its strong policial tie-ins. With Daschle and Dole both on its payroll as consultants,it reminds me of my own 50 years in the legal profession. Judges on matters of discretion or of situations that they do not really have the background to decide will invariabley rule in favor of friends or attornys with whom they are best acguainted or familiar!
I still feel that Idcc will prevail, but it might have to be in a Federal Court Appeal. Tucker

Sometimes an attorney must "go over the top" to expose a Judge's lack of knowledge or understanding of a point. Believe me when I say that the next time you appear before that Judge and he knows that the attorney is not going to go along and just take it because he has other cases before the same judge, he will get a better hearing or trial. Some will say that it is just 2nd guessing but I am on record as saying Sanders was "out of the Loop" and that Lynne and Batts were just plain wrong as to what the law of the case should be! After Reading Idcc's brief, it is my opinion that Luckern will be overruled!Tucker
Osoesq, I agree with you and the poster "Eagle". It is time to go to Delaware and have a trial. Sanders proved he was out of it and perhaps Luckern is also when it comes to "cutting the baby in half" rulings!! My opinion only, but I also said that Lynne would be reversed for allowing Nokia to be heard on a matter that it was not entitled to be heard. As for not hearing from me , it has been my feeling for sometime that legally Idcc is in good shape, but all we have to do is wait for the legal system to keep moving on at its usual "snells pace" with all of the legal delays and roadblocks being thrown up to finally see a big payday. In my opinion , our legal system should have been able to resolve all of the claims years ago, but that is just not the way our system works! Also, loop , yourself and the other legal eagles have been doing such a good job that I really had nothing to add! Wishing all a great Christmas and Holiday Season with a nice payoff for Idcc before the end of the year! Tucker

Jim ,At first I thought that Judge Sanders would be a good judge for Idcc to be before, but ,later, I felt that when it came to patent litigation that he just was not up to speed and he cost Idcc dearly.

my3sons87, I will be waiting to see what happens before Monday because if there is not an agreement and a stipulation as to what is owed for 2 and 2.5G by Samsung for 2006, then we are faced with a hearing to present evidence as to what is owed. This would mean further arbitration as to the amount owed by Samsung for 2006! Of course that just means further delay! My answer to Samsung if I was Idcc would then be: Fellows the honeymoon is over, I want ever last copper up to the time the money is actually received! Tucker

Ghors, I have found, in my opinion, that after 50 years as a lawyer and 40years in active practice, you are absolutely correct in your assessment of the litigation scene in our businesses and court systems!
It is my opinion again, that the people who should care- the citizens- do not and I only expect the abuse of litigation as a business tool to continue. Little companies like Idcc pay the price and it is the stockholders who are denied justice and fair dealing! Tucker

In my opinion , they have done an excellent job keeping the board inform as to what is happening legally. My biggest complaint is that our wheels of justice move so slowly that it is a disgrace! For example , the Batts decision is wrong and it should of been already reversed and Idcc moving toward a conclusion instead of 10 Attornies for Idcc signing an almost meaningless motion. Loop has hit the nail on the head in his complaints about the mounting and never ending legal fees; however , it appears that the legal mess is about to be on a course now for some results! Tucker

Ghors, Cronyn is definitely , in my opinion , a sorry senator, and I was very glad to see him leave the Texas Supreme Court as his opinions were definitely in favor of only the people and companies that spent the money to keep him in politics! His answer to me about patent legislation was such that it is obvious he is going to keep pushing the bill that he has co-sponsered! Ghors, I pulled my license from the wall after about 40years because I became tired of the courts not really being in session and the failure of the judges to be prepared and not working. Come to Houston and I will take you around and show you that the judges disappear around noon on Wednesday. I was once talking to 2 Texas Supreme Court Justices at a bar function when a Senior Federal Judge walked up and asked what was the topic of conversation. The Texas Judges looked at me and I answered the question as follows: "We were discussing if federal judges should be elected. I believe that they should be, because it is almost impossible to get rid of an incompent federal judge!" Judge Lynn and Batts make me wonder about their credentials! Tucker

Loop, sometimes people want to believe what they see is right, even though their eyes are deceiving them. As any trial lawyer knows a judge who just looks disgusted with what he is hearing does have an effect on a jury. Yes, a federal judge can and often does comment on witnesses testmony either through body language, questions he is allowed to ask of witnesses and comments he might wish to make. I liked our Texas Rules that does not allow a Texas Judge to comment on the evidence in front of a jury and he can be reversed if he does so; therefore, do not let people get under your skin who know a little law and it gets them into trouble because they do not know what is required as to the "burden of proof" , persumptions and othe legal niceties! I enjoy reading what you , Gohrs, Whizzer and other lawyers have to say on this board as it saves me a lot of time in following the many litigations going on that affects Idcc. I hope you will continue to keep your legal opinions and positions posted on this board because they are a great service to us all.
We will not get in to dicussing the rules that apply to many administrative bodies that lawyers also must follow that do differ a great deal from court room rules, etc.!

Whizzer, Ghors , loop and yourself are doing a fantastic job of covering the Legal front. The Houston Cabal is a great group of gentlemen that are knowledgable about many things and are willing to share their opinions on many subjects! You would certainly enjoy yourself if you came to The Houston Cabal's 100 party.
I would weigh in more on the legal front, but since I am known to take strong postions on Judges like "no juristition Lynn" and now "I do not have time to really know what this is all about Batts", I have stayed out of the legal debates of late because not only is Batts "Batty" but she has no legal support in the ruling and she will be overruled!
The truth is I am retired , my wife will not type for me and I am too slow a typist to say what I want to write without my fingers cramping! However, in one respect, I am luckier than LOOP, as my wife is now cooking our dinner! I might add that I did tell her that the next time that I go to Europe she can go along if she buys the tickets!Tucker
Loop, someone asked on the board what was our remedy if the Judge did not rule the way she should have in my opinion. I started to answer and finally decided that if the question was not clear enough for the Judge to understand what the question was that we would get an "half baked" decision that could be appealed. Of course one might have a remedy, but when one has to spend money, lose time, the stock price is disrupted and the investors lose money(or spend money) because some judge is really unqualified to answer the question and has not fully briefed herself on the facts and the law then an unfair judgement is fostered on the public and for which, in reality, there is no remedy.
My son Tommy was a law clerk for a federal judge and my practice included the federal courts and I feel I know something about the system, but when judges make decisions like Judge Lynn in Dallas and then this judge's decision, I feel that there is no justice raally because a bad decision that should not have been made, the continuous litigation and the courts allowing the richer party to literally break a company and steal another party's Intellectual Property is not justice , but it is a system that fosters thievery. My answer to the poster really is that we do not have a remedy!Tucker
