If you say Denver is going win the Superbowl, were you lying if they lose? Most people wouldn't say you lied there. Businesses must be given flexibility. They make plans and change them. When they change, that does not mean companies intended to deceive. It just happens, and if you do not have flexibility here....you need to get out of the investing arena.
In order for it to be a lie, then the burden of proof is on you to show there was intent to deceive. This would be impossible to prove, without access to emails or evidence demonstrating that Kim intended to deceive. A PR delineating plans that never occur, is not by definition a lie. Reread that until you understand it. If I didn't have a sense of humor, this would be hard to watch.
