lets suppose that the right of first refusal exists until 2016. if a third party were to buy out or merge with lqmt they would eventually have the right not to renew any expiring agreements with apple. also, it would give the third party leverage to negotiate future technology swapping tech with apple. i can think of many companies that might like to be in that position. suppose there are more than one interested 3rd parties in this opportunity.
