jom---No reason to apologize and your comments weren't a rant. Whether you’re right or wrong, your points show you’ve obviously been paying close attention to what’s going on. I’d say your points are well-taken. (You’ve sold half your position; well, I haven’t been jumping in & out. Mostly just jumping in more & more. My relatively long-term bet on this case is turning into a longer-term bet than I originally expected, but I still think we have the facts and law, as well as a jury decision, on our side.) who does delay benefit? the winner or loser?

so plain...aren't lawyers and legal documents supposed to be very specific?

No question that there currently is no map setting forth when we may reach a final destination at the trial court level in this case. That simply doesn't exist, and any expectations of when that may occur may get blown all to hell in a hand basket.

Any expert(s) the judge chooses will have to have the opportunity to look at the claimed W/A. One would think they would at least get 2-3 weeks to do so since they are entering this picture cold turkey.

When will the judge decide which expert(s) he wants to use? How quickly will they be provided with what they need to make an evaluation of the W/A? What is the chosen expert(s) availability to work in it? Once that is done, when will HJJ make a ruling and get this case finalized? Will he set a hearing on the W/A? I think the odds are that he will do so. Will he decide on the W/A and give the parties yet ANOTHER opportunity to settle? I hope to hell not!

It would be nice if everything were fully scheduled and cut and dried. However, it's not. Let's all hope HJJ picks up the pace a little here and get this over with.
