#3537 RE: Frackedup #3535

Fracked, I like how you finess the main point that I made, that Iterated's base source code doesn't work without TMMI's proprietrary enhancements.

So to make my Android analogy clearer, without Samsung's Touchwiz or HTC's Sense, Android would never make it out the door. Google essentially delivered the kernel (in Iterated's case the Fractal Transform), but never developed the rest of the software that can make use of it.

So how does this tech that can't work without TMMI tech wind up somewhere else. Why don't you answer this one since you are so all knowing? Where is the trail of paperwork that establishes the transfer of TMMI proprietary tech?

And you know quite well that TMMI was in bankruptcy court in 1996 so give up the company's sole assets would require a judge's permission. The 1993 agreement was paid in full according to TMMI. They went ahead to develop and sell products with it.

I seriously dobut that the 1996 agreement was ever intended to supercede any previous agreement without just compensation. That would require the original 1993 agreement to be amended to give up the rights already paid for but why would anyone do that? Even if they wanted to, they would need a judge to sign off on it since there were creditors in line.

Continue to ramble on all you want, but you have a steep mountain to climb.
